Judge Directs US Attorney To Collect $20K From Orly Taitz After Failure To Pay Fine | TPMMuckraker

advertisement

The Birther Queen refuses to pay.

A federal judge in Georgia has ordered the US Attorney to collect a $20,000 judgment against Orly Taitz after the Birther attorney failed to pay the fine -- which she appealed -- within 30 days.

Here's /www.talkingpointsmemo.com/documents/2009/11/order-for-final-judgement.php?page=1>the full order from Judge Clay Land, of the US District Court in the Middle District Of Georgia:

"Orly Taitz has failed to pay the $20,000.00 sanction ordered by the Court on October 13, 2009. Accordingly, the Clerk is ordered to enter final judgment in favor of the United States of America and against Orly Taitz in the principal amount of $20,000.00. The United States Attorney is authorized and directed to collect the judgment as provided by law.
IT IS SO ORDERED, this 13th day of November, 2009. "

This visualization below allows you to see the impact that each user has on the current conversation. The top row contains the group of users who have had the most impact, the 2nd row the group of users who have had the 2nd most impact (et cetera). Users with similar impact are grouped together, and the average score of the group is shown to the left of the group. The author of the article is also shown on the left, in their corresponding group. Each user's score is based on the number of comments the user has made plus the number of votes their comments have received. The scores are calculated relative one another, so while their absolute value is not particularly important, their relative difference does indicate a larger difference in impact on the conversation.

Let's see. Per the order, interest begins accruing as of today. Sadly, the rate is one any of us would covet wildly for our mortgages.

Presumably, they'll attempt to contact her to set up a payment plan. Should that fail, they'll likely be able to place liens on her tax returns, her properties (she owns the building in which she has her dental/attorney offices, IIRC), and quite likely her husband's income.

Yes, they'll go after all they can that belongs to her. I don't think they can attach spousal income, can they? (I didn't even know she was married? Geeze, how could anyone live with that nut?).

If she refuses to pay a duly ordered fine imposed by the court, the next step is contempt of court, which could bring jail time. Or additional fines. Or both. Hopefully, both.

At least she wouldn't have to become a jailhouse lawyer: but given her talent as an attorney, she might want to hire one.

Mail-order Bride?!

Rumor has it that she married her husband after the second date, so that is a distinct possibility.

Lincoln's affidavit (Linked in post #4) mentions her husband threatening to make her sign over interest in all of their joint property, which would make sense if they're concerned about the sanctions putting liens on everything they own.

I thought conservatives were all for tort reform and against frivolus law suits.

not to nit pick, but torts are civil actions to recover monetarized damages for violations of protected interests, i.e. injury to your person, property, reputation and the like. Orly is involved --not considering the merits of her allegations-- in a constitutional challenge. Tort reform is inapplicable; but I agree conservative are seeking to limit the types of actions taht can be brought and the amount of damages taht can be recovered through this "tort reform" movement. Further tort reforms are decidedly benefitial to insurance companies that generally pay out the dmages awards and wealthy defendants (corporate or individual) who are more likely to be the subject of a law suit. (The unspoke rule of tort attorneys is find a plaintiff with serious damages and a defendant with deep pockets and you got a good case.)

Secondly, "frivolous law suits", as defined by conservatives, are any claims by an injured party that infringe upon the wealthy--regardless of fault, guilt or liability.

Just thought I'd throw that out there.

Something that is just as ironic (sort of) is that "standing" is an issue that has been tightened by Conservative Supreme Courts over the last several decades.

And now some of the more conservative birthers are complaining about the "technicality" of standing.

Certain courts have banned people as vexatious litigants - generally people who have filed many nuisance suits in the same court. The filth known as Andy Martin was banned from future pro se filings in Connecticut, after he filed suit after suit with no merit, and after dismissals, made a number of vile comments about the judges being Jewish.

I think O'Rly? has spread herself out among many courts, but if she hits one more than once, she might fae this.

actually, every state has a few unaccredited law schools. The caveat is that degrees from unaccredited school permits one to practice only in the state where the degree was bestowed. Unlike an accredited school where a grad can take the bar and practice anywhere in the US, unaccredited degrees are "qualified" or "limited" degrees. Nah, he's not suing her... That's his excuse note to a judge. See, he was helping her with the birther cases, in exchange for her representing him (and others) in HIS cases. However, apparently his cases aren't in California, which is the only state where she's actually licensed to appear. (Some judges have allowed her to appear without being licensed by their states, and have regretted it.) She filed to appear for Lincoln, and the judge said no. (The regulations are that if you want to appear in a state not your own, unless the court waives the requirement, you must have an attorney licensed in the state associated with the case, to ensure that SOMEONE on the team knows how the court system in the state works, such as specific filing requirements.)

          Rainkiss

For those interested, apparently all is not well in Orlyland. There's an affidavit filed by Charles E Lincoln III in one of his many lawsuits, here:

Rainkiss I can't remember who was the one who said she ask him to lie can you give me the name.

Sorry, wrong one, there were two who came forward saying she asked them to lie. Lucas Smith is the other, and is the one who first made public allegations that Orly and Lincoln were having an affair.

(The regulations are that if you want to appear in a state not your own, unless the court waives the requirement, you must have an attorney licensed in the state associated with the case, to ensure that SOMEONE on the team knows how the court system in the state works, such as specific filing requirements.)

That is partially correct: one must file an application to the Supreme Ct of the State for what is called "Pro Hoc Vice" and one must associate with a local counsel, licensed to practice within the state. The applying attorney must submit a certificate of good standing from the resident state, and the receiving court can deny the motion for any cause.

ICE should look into whether proper channels were followed for her immigration to the US from Moldavia.

Oh, then you haven't fully achieved the flavor or Orly. You have to watch at least a few videos of her, so that when you read her statements or filings you can imagine her saying them in her "Moose and squirrel" voice and accent.

That's not hating on them. Listen to her accent, you'll understand.

It is not possible to listen to her speak without the words "Moose and squirrel" or "Boris, dahling" springing to mind.

I was told once that a true intellectual is someone who can hear the William Tell Overture without thinking about the Lone Ranger. I'm beginning to see a corollary here - someone who can listen to an Orly Taitz video without thinking "moose and squirrel", or having the Rocky and Bullwinkle theme play in the back of their minds (da da dadumdada dadada-dadumdada). I can tell you - it's not possible for me to do either one.

There is a picture of Orly in the dictionary next to the phrase "lunatic fringe"
